1. Definitions

For the purposes of this document, the following terms shall have the meanings indicated below:

• Kioskak or the Platform: Refers to the Kioskak website and all associated digital services and applications owned and operated by the management.
• Management or We: The entity that owns and operates the platform and is responsible for its technical, commercial, and legal administration.
• User: Any individual browsing or using Kioskak’s services, including buyers, sellers, and visitors.
• Seller: Any individual or entity registered on the platform for the purpose of offering and selling products or services via Kioskak.
• Buyer: A person who purchases products or services via the platform.
• Product: Any item or service listed for sale on Kioskak by sellers.
• Account: The user or seller’s personal profile created upon registration, containing their data and transaction information.
• Content: All data, comments, images, and reviews submitted by users on the platform.
• Policies: All legal guidelines published on Kioskak, such as the Privacy Policy, Return Policy, Payment Policy, and others.

2. Account Creation & Responsibilities

• Users must provide accurate and complete information when creating an account.
• Users are responsible for maintaining the confidentiality of their login credentials.
• Users must be 18 years of age or older. Those under 18 may only use the platform under parental or legal guardian supervision.
• Kioskak reserves the right to suspend or terminate accounts that violate these Terms or are used unlawfully.

3. Use and Conduct

• The platform may only be used for lawful purposes.
• Any fraudulent, harmful, or rights-infringing activities are strictly prohibited.
• Creating multiple accounts for manipulation or harm is not allowed.
• Posting content that is threatening, abusive, incites violence, infringes copyrights, or is otherwise illegal or inappropriate is prohibited.
• Sending unsolicited promotional emails (spam) via the platform is not permitted.

4. Content & Intellectual Property

• Users may post reviews, comments, and product-related content, provided it is truthful and appropriate.
• Users grant Kioskak the right to use submitted content for marketing or operational purposes at no cost.
• Kioskak reserves the right to edit or remove any content that violates these Terms or applicable laws, without prior notice.
• Copying, redistributing, or commercially reusing any platform content is prohibited without written permission.

5. Sales & Purchases

Seller Responsibilities:

• Sellers must offer genuine products that match their descriptions and meet quality standards.
• Sellers must clearly outline their return and exchange policies.
• Sellers or their contracted shippers are responsible for ensuring on-time delivery.

Buyer Responsibilities:

• Buyers must provide accurate purchase information, including delivery address and payment details.

Payment Options:

• The platform supports secure electronic payment gateways and Cash on Delivery (COD), where available.

6. Pricing & Fees

• Displayed prices typically include applicable taxes and additional fees, and the final amount is shown before confirming the order.
• Kioskak reserves the right to cancel orders or suspend accounts in cases of payment issues or delays.

7. Returns & Refunds

• Buyers may request returns within the seller’s specified period (typically 7 to 14 days) if the product is defective or not as described.
• Return requests must include valid evidence, such as photos and descriptions.
• Used, customized, or non-returnable products due to health or legal reasons are not eligible.
• The seller bears return shipping costs in case of defects or inaccurate descriptions.

8. Privacy & Data Protection

• Kioskak is committed to protecting user data and uses it only to operate and improve services.
• User data will not be shared with external parties without consent, unless legally required.
• Users may edit or delete their information through account settings or by contacting support.

9. Advertising & Promotions

• Kioskak offers paid promotional services to sellers to increase product visibility.
• Management reserves the right to review or reject ads that violate laws or platform policies.
• Kioskak is not responsible for content published in ads by sellers or third parties.

10. Account Suspension & Termination

Kioskak actively monitors account activity. Accounts may be suspended or terminated in the following cases:

• Repeated complaints about user behavior or product quality
• Seller delays or failure to meet shipping obligations
• Fraudulent activity or violation of Terms Users will be notified upon account suspension and given a window to appeal.

11. Disclaimer & Warranties

• Kioskak is merely a facilitator and is not directly responsible for products or services sold by sellers.
• All platform services are provided “as is” and “as available” without warranties of any kind.
• Kioskak does not guarantee uninterrupted access, error-free service, or issue correction.
• Kioskak is not liable for the accuracy of seller content or products listed.
• In disputes between buyers and sellers, Kioskak may mediate but assumes no legal or financial liability.
• To the extent permitted by law, Kioskak is not liable for any direct, indirect, incidental, special, or consequential damages, including loss of profits or data.

12. Intellectual Property & Trademarks

• All intellectual property rights related to the site and its contents belong to Kioskak.
• Unauthorized use of the Kioskak name, logo, or trademarks is prohibited.
• Violators may face legal consequences.

13. Indemnification

Users agree to indemnify and hold harmless Kioskak, its management, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

• Violation of these Terms
• Violation of laws or third-party rights
• Any content uploaded or shared by the user on the platform

14. Amendments to Terms

Kioskak reserves the right to modify these Terms at any time. Users will be notified of major changes via platform notice or registered email seven (7) business days before changes take effect. Continued use of the platform indicates acceptance of the revised Terms.

15. Force Majeure

Kioskak is not liable for delays or failures caused by circumstances beyond its control, including natural disasters, wars, civil unrest, strikes, power outages, or major technical failures. Obligations are suspended in such cases, with notification to the other party.

16. Third-Party Links

The platform may contain links to third-party sites or services. Kioskak is not responsible for the content, privacy policies, or practices of such sites. Users are encouraged to review the terms and privacy policies of any third-party website they visit.

17. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of Lebanon. In case of any disputes arising under or related to these Terms, parties agree to attempt resolution through amicable settlement. If unresolved, disputes shall be subject to the exclusive jurisdiction of the competent courts in Beirut, Lebanon.
